The Antisocial Behaviour (Scotland) Act 2004 introduces new powers for children's hearings to increase local authority accountability.
Where a hearing discovers that a supervision requirement has not been properly implemented it may require the reporter to refer the local authority to the Sheriff.
Separately, where a hearing discovers that a child excluded from school is not receiving education the hearing may refer the child’s case to Scottish Ministers for action to be taken.
Consultation on draft guidance took place in autumn 2004 and this part of the Act commenced in January 2005.
